IP attorney William R. Trueba Jr., a founding member of the law firm of Espinosa Trueba Martinez PL, won the Daily Business Review's 2014 Most Effective Lawyer Award on December 5, 2014 (in the category of Intellectual Property). As the ‘last man standing’, Trueba was recognized for winning a major victory in June 2014 in a patent infringement lawsuit, Tawnsaura v. Vitacost.com. The firm's client, Vitacost.com, an online vitamin supplement retailer, was one of 88 vitamin and supplement companies nationwide sued by Tawnsaura Group, a CA-based non-practicing entity (NPE), referred to by some as a patent troll. Trueba was part of a joint defense group, but ended up arguing the entire case himself after the other parties, whose attorneys were scheduled to argue parts of the motion, settled 24 hours before the hearing in federal court in Los Angeles. Trueba worked through the early morning hours the night before to prepare to make the entire argument. The next morning, after arguing the Motion for Summary Judgment, U.S. District Court Judge S. James Otero ruled from the bench in Vitacost.com’s favor. The outcome also benefitted 15 other remaining defendants who had not settled their cases.
